The terms and conditions for online orders, described below, apply to all orders placed from the online platform www.florenciashop.com, and are available to the customer at all times, so that he can view them whenever he wants from our website. FlorenciaShop reserves the right to adapt and/or modify these general terms and conditions for orders placed online, at any time. The applicable version of the terms and conditions of an order is the one published on the website at the time of placing the order. Consequently, our general terms and conditions are accepted without reservation.

Client

Once the customer registers his personal information on our website, he must ensure the accuracy and completeness of the data provided. In case of error in the wording of the recipient's data, FlorenciaShop cannot be held responsible for not being able to deliver the order.

Products

The products offered for sale are those described on the website on the day the customer consults them and as long as the company has available stock. FlorenciaShop pays the greatest attention to the presentation and description of the products to offer the customer the best possible information. However, non-substantial errors may occur on the website that the customer knows and accepts. In case the product shipped does not match its description on the website, the customer may exercise his right of withdrawal or exercise all warranty rights stipulated by applicable law.

Orders

The acceptance of an order placed on our website is subject to the procedure made available to the customer to validate his orders. Any order validated by the customer coincides with the sales contract and signifies acceptance of all the clauses of these terms and conditions. FlorenciaShop will send an email to the customer summarizing the order (products, prices, availability of products, quantity, etc.). For this purpose, the customer formally accepts the use of his/her email to receive confirmations of the contents of the orders, by FlorenciaShop, in any case. Invoices can be found in the "My Account" section. The customer has the right to withdraw from this contract without any justification, within 14 (fourteen) days. The withdrawal period expires 14 days after the customer acquires material possession of the product.

Prices and terms of payment

Certain countries, outside the European Union, may be subject to additional costs (for taxes or customs) after receipt of the order and depending on the legislation of your country. FlorenciaShop reserves the right to change its prices at any time, but products will be invoiced based on the rates applicable at the time of the order. The products must be paid for at the time the order is placed. Purchases must be paid for by credit card, through the Servired service of Banco de Sabadell. The customer expressly acknowledges that the disclosure of his/her card number to FlorenciaShop gives the company authorization to debit the price of the product from his/her account. The data stored by FlorenciaShop gives proof of all orders and transactions. The data stored by Servired constitutes proof of the financial transactions.

Shipping

Shipping is free for orders over 10 €, only and exclusively for the Iberian Peninsula. Shipments are delivered by the company *GLS, from Monday to Friday, depending on the option chosen by the customer at the time of order validation. The shipment is made to the address indicated by the customer. The orders are sent with an average of two (2) days, but this period can be extended up to ten (10) working days, in particular when a new collection has recently been published online, because of the high number of orders that may have. In order to meet the deadlines, the customer must ensure that he has provided complete and correct information regarding the delivery address (including in particular the address, building number, scale, access codes, etc.). *FlorenciaShop will ship orders with a maximum delay of twelve (12) working days for European orders and twenty (20) working days for international orders, from the day after the validation of the orders. In the event that the delivery time is extended and not justified, for reasons that are significantly longer, the customer can request the cancellation of the order and receive their money within a maximum period of fourteen (14) days. The times described above are indicative deadlines, which correspond to the average times required for shipment of products. *FlorenceShop cannot be held responsible, as a consequence, for the delay of the deliveries that are made if the reason is caused by a major cause or derived from third parties. Legal right of withdrawal

Consumers have a Right of Withdrawal in relation to purchases made through online stores, which entitles them to return products. The Right of Withdrawal is regulated by RDL 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users. This right is justified by the need to protect the consumer against the fact that he or she is making a distance purchase which is understood not to have all the sufficient elements for a proper assessment and, therefore, may not be interested in it later. The customer has the right to withdraw from this contract, without the need for any justification, within a period of fourteen (14) days. This period will expire fourteen (14) days after the customer or a third party indicated by him, other than the carrier, acquires material possession of the products. To exercise the right of withdrawal, the customer must notify it to: Florencia Online S.L. Avda. Eduard Maristany 408, 08918-Badalona (Barcelona), or by email to: orders@florenciashop.com, by means of an unequivocal statement. The customer may use the model Withdrawal Form below as Appendix I, although its use is not mandatory, or, alternatively, the Withdrawal Form received with the order. If the customer informs us of his decision to withdraw from the purchase, we will send him an acknowledgement of receipt by e-mail. In order to comply with the withdrawal period, it is sufficient that the communication regarding the exercise of the withdrawal is sent before the expiry of the period. The products must be returned in their original packaging and condition, unused and unwashed. In case of withdrawal by the customer, we will proceed to reimburse all payments made by the customer, excluding shipping costs (with the exception of additional costs resulting from the choice by the customer of a shipping method other than the least expensive ordinary shipping method that we offer, without any undue delay and in any case within fourteen (14) days from the date on which we have been informed of the decision to withdraw. The refund will be made using the same payment method the customer used for the initial transaction. The customer will not be charged any fees as a result of the refund. We may withhold the refund until we have received the products, or until the customer has provided proof of return of the products, depending on which condition is met first. The products must be returned or delivered no later than fourteen (14) days after the date on which you inform us of your decision to withdraw from the contract.
The deadline will be considered met if the customer returns the products before the 14-day deadline has expired. The customer must pay the return shipping costs and is only obliged to cover the depreciation in value of the products if this depreciation is the result of improper handling of the goods when examining their condition. In any case, the costs of returning the products will be covered by FlorenciaShop if the product sent is in bad condition, is defective and/or is very different from the product ordered (not counting the alterations caused by making it visible on various digital media). If the customer does not accept these terms and conditions, including the conditions of return or exchange, FlorenciaShop cannot proceed to refund the products in question.

Exchanges and returns

You have up to 30 working days from the date of purchase to return or change your order purchased online. Here are the different options.

  • Free in-store return: You can return an item purchased online to one of our selected Florence stores. You have up to 30 working days from the date of purchase to return the item. Here are the steps to follow:

    2.- Print the order: In the section 'My orders', print the purchase invoice.

    3.- Shop delivery: Once in the store, deliver the item you wish to return along with the purchase invoice. The garments must be in the same condition in which they were received: in perfect condition, with their corresponding label and conserving their original packaging. You will be given a receipt of delivery which you must keep until the refund is effective.

    4.- Refund: The refund will be made within a maximum of 15 days, using the same payment method used in the purchase.

  • Return to home: If you do not have availability to approach one of our stores available for returns, you can send us the garments purchased online that you wish to return directly to our headquarters. In this case, the shipping costs will be paid by the customer. You have up to 30 working days from the date of purchase to make the return. Here are the steps to follow:

    1.- Print the order: In the section 'My orders', print the purchase invoice.

    2.- Prepare the package: Enter the garments you wish to return in the original packaging along with the printed purchase invoice. The garments must be in the same condition in which they were received: in perfect condition and with their corresponding label.

    3.- Shipment: Send the package to the following address:

    4.- Refund: Once the package has been received at our headquarters and we have checked that the items are in perfect condition, we will proceed to refund the amount within a maximum of 15 days, by means of the same method of payment used in the purchase.

  • Changes:For items purchased online, changes in size and color of the same item will only be accepted, in selected stores (we do not make changes at home):

    You have up to 30 working days from the date of purchase to make the change. We do not exchange any item purchased online for a different one, in that case the buyer must return the item and make a new purchase online.

The relationship between the user and Florencia Online, S.L. will be governed by the regulations in force and applicable in the Spanish territory. Should any dispute arise, with regard to the interpretation and/or application of these conditions, the parties will submit their disputes to the ordinary jurisdiction, i.e. to the Courts and Tribunals that correspond in accordance with the law.
