Terms and Conditions

The terms and conditions for online orders, described below, apply to all orders placed through the online platform www.florenciashop.com, and are available to the customer at all times, so they can view them whenever they wish from our website. Florencia reserves the right to adapt and/or modify these general terms and conditions for online orders at any time. The applicable version of the terms and conditions for an order is the one published on the website at the time the order is placed. Consequently, our general terms and conditions are accepted without reservation.

Customer

Once the customer registers their personal information on our website, they must ensure the accuracy and completeness of the data provided. In case of an error in the recipient's data, Florencia cannot be held responsible for not being able to deliver the order.

Products

The products offered for sale are those described on the website on the day the customer views them and provided the company has available stock. Florencia pays the utmost attention to the presentation and description of the products to offer the customer the best possible information. However, non-substantial errors may occur on the website that the customer acknowledges and accepts. In the event that the product shipped does not match its description on the website, the customer may exercise their right of withdrawal or exercise all warranty rights stipulated by applicable law.

Orders

The acceptance of an order placed on our website is subject to the procedure made available to the customer to validate their orders. Any order validated by the customer constitutes a sales contract and signifies acceptance of all clauses of these terms and conditions. Florencia will send an email to the customer summarizing the order (products, prices, product availability, quantity, etc.). For this purpose, the customer formally accepts the use of their email to receive order content confirmations from Florencia, in any case. Orders can be found in the "Account" section. The customer has the right to withdraw from this contract without any justification, within a period of 14 (fourteen) days. The withdrawal period will expire 14 days after the customer acquires physical possession of the product.
PRICES AND PAYMENT CONDITIONS Certain countries outside the European Union may be subject to additional costs (for taxes or customs duties) after receiving the order and depending on the legislation of their country. Florencia reserves the right to modify its prices at any time, but products will be invoiced based on the rates applicable at the time the order is placed. Products must be paid for at the time the order is placed. Purchases must be paid by credit card, through the Shopify service. The customer expressly acknowledges that the disclosure of their card number to Florencia authorizes the company to debit the product price from their account. The data saved by Florencia provides proof of all orders and transactions. The data saved by Shopify constitutes proof of financial transactions.

For orders of more than €80 as a final amount (for store products, including shipping costs), a surprise "Wonder" jewel will be included.
For orders exceeding €120 as a final amount (for store products, including shipping costs), a surprise "Carré" scarf will be included completely free of charge, and finally, for orders over €200 as a final amount (for store products, including shipping costs), an exclusive "Femme" handbag will be included at no additional cost.
Unless there is a program error, for orders that do not exceed these total amounts, the corresponding gift will not be included (even if it is reflected in the final order summary).
These gifts may be omitted or substituted due to stock limitations or depending on current campaigns.


Shipping

Shipping is free for orders over €40, exclusively for Spain. Shipments are delivered by the company *GLS, from Monday to Friday, depending on the option chosen by the customer at the time of order validation. Shipping is made to the address indicated by the customer. Orders are shipped on average within two (2) days, but this period may be extended up to ten (10) calendar days, particularly when a new online collection has recently been released, due to the high volume of orders that may occur. To meet deadlines, the customer must ensure they have provided complete and correct information regarding the delivery address (including, in particular, the address, building number, floor, access codes, etc.). *Florencia will ship orders with a maximum delay of twelve (12) calendar days for orders to Europe and twenty (20) calendar days for international orders, from the day after order validation. In the event that the delivery time is extended and not justified by force majeure, the customer may request cancellation of the order and receive their money within a maximum period of fourteen (14) days. The times described above are indicative deadlines, corresponding to the average times required for product shipment. *Florencia cannot be held responsible for delivery delays caused by force majeure or third parties."

The 24-72 hours that Florencia offers for the shipping and delivery of orders in the peninsula (Spain), through the company GLS, are Monday to Friday, i.e., business days.
If an order is placed (and consequently, Florencia receives it) on a Friday afternoon (after 3 PM), Saturday, or Sunday, the 24-72 hours will start counting from Monday at 9 AM or, if it is a holiday, from the next business day.

Legal Right of Withdrawal

Consumers have a Right of Withdrawal in relation to purchases made through online stores, which entitles them to return products. The Right of Withdrawal is regulated in Royal Legislative Decree 1/2007 of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users. This right is justified by the need to protect the consumer against making a distance purchase for which they may not have all sufficient elements for an adequate assessment and, therefore, may not be interested later. The customer has the right to withdraw from this contract, without any justification, within a period of fourteen (14) days. This period will expire fourteen (14) days after the customer or a third party indicated by them, other than the carrier, acquires physical possession of the products. To exercise the right of withdrawal, the customer must notify: Florencia Retail S.L. C/ Juli Galve Brusson, 55, 2-1, 08918 Badalona (Barcelona), or by email to: pedidosonline@florenciashop.com, by means of an unequivocal statement. The customer may use the Withdrawal Form template below, as Annex I, although its use is not mandatory, or, alternatively, the Withdrawal Form received with the order. If the customer informs us of their decision to withdraw from their purchase, we will send an acknowledgment of receipt by email. To comply with the withdrawal period, it is sufficient that the communication regarding the exercise of this right is sent before the period expires. Products must be returned in their original packaging and condition, unused and unwashed. In case of withdrawal by the customer, we will proceed to reimburse all payments made, excluding shipping costs (with the exception of additional costs resulting from the customer's choice of a shipping method different from the least expensive ordinary shipping we offer), without undue delay and, in any case, within fourteen (14) days from the date on which we were informed of the decision to withdraw. The refund will be made using the same payment method the customer used for the initial transaction. No charge will be made to the customer as a result of the refund. We may withhold the refund until we have received the products, or until the customer has presented proof of their return, whichever condition is met first. Products must be returned or delivered, at the latest, within fourteen (14) days from the date on which the customer communicates their decision to withdraw from the contract. The deadline will be considered met if the customer returns the products before the 14-day period has expired. The customer must pay the shipping costs of the return and is only obliged to cover the depreciation in the value of the products if it is a consequence of improper handling of the merchandise when examining its condition. In all cases, the costs of returning the products will be covered by Florencia if the product sent is in poor condition, is defective, and/or is very different from the product ordered (not counting the alterations caused by making it visible on various digital media). If the customer does not accept these terms and conditions, including the return or exchange conditions, Florencia cannot proceed to refund the products in question.

Exchanges and returns

    3.- In-store delivery: Once in store, hand over the item you wish to return along with the purchase invoice. Items must be in the same condition in which they were received: in perfect condition, with their corresponding tag and original packaging. You will be given a delivery receipt that you must keep until the refund is effective.

    4.- Refund: The refund will be processed within a maximum of 15 days, using the same payment method used for the purchase.

Refunds for online orders will only be issued in cash, to the same card used for the purchase.
For returns of purchases made in any of our physical stores, a "Voucher" equivalent to the value of the item(s) being returned will be issued, with no time limit for redemption.

Home delivery returns: If you are unable to visit one of our stores that accept returns, you can send the items purchased online that you wish to return directly to our headquarters. In this case, shipping costs will be borne by the customer. You have up to 30 calendar days (15 days during sales) from the date of purchase to make the return. Here are the steps to follow:

1.- Add the order you will find in the "Account" section or write a note inside with your full name, date of purchase, and order number.

2.- Prepare the package: Place the items you wish to return in their original packaging along with the printed purchase invoice. The items must be in the same condition as when they were received: in perfect condition and with their corresponding tag.

Exchanges: For items purchased online, only exchanges for size and color of the same item will be accepted in selected stores (we do not offer home exchanges).

Florencia does not guarantee the veracity, accuracy, integrity, usefulness, suitability, reliability, availability, timeliness, opportuneness, legality, absence of viruses, or other harmful elements on the website or in the contents. The user is aware and voluntarily accepts that the use of the website and contents is under their sole and exclusive responsibility. Florencia has adopted appropriate protection measures, but does not guarantee the privacy and security of the use of the website and, in particular, will not be responsible for any damage or harm derived from the loss or disclosure of information that may occur during the use of the website or its contents. Florencia does not guarantee the availability and continuity of access to the website or its contents at any time. Florencia excludes all liability for damages of any nature that arise directly or indirectly from the access and use of the website or its contents, or from the delay or inability to use the contents. If the user is not satisfied with any part of the website or its contents, or with any of these Terms of Use, the user's sole and exclusive remedy will be to stop using the website. Legal Notice

FLORENCIA RETAIL, S.L reserves the right to take any civil or criminal action it deems necessary for the improper use of the website, its contents, and/or for non-compliance with these conditions. The relationship between the user and FLORENCIA RETAIL, S.L will be governed by the current and applicable regulations in Spanish territory. Should any controversy arise regarding the interpretation and/or application of these conditions, the parties will submit their conflicts to the ordinary jurisdiction, i.e., the corresponding Courts and Tribunals in accordance with the law.
